These Terms of Use (“Terms”) explain your rights and responsibilities when using Heartchive (the “Service”). By creating an account or using Heartchive, you agree to these Terms. If you do not agree, please do not use the Service.

Who We Are

Heartchive, Inc. (“Heartchive,” “we,” “us,” or “our”) provides a journaling, memory-keeping, and organization app. Heartchive is not a healthcare provider and does not offer therapy, clinical advice, or medical services.

Eligibility

You must be 16 years or older to use the Service. By using Heartchive, you confirm you meet this requirement. We do not knowingly allow children under 16 to create accounts.

Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you believe your account has been accessed without permission, please contact us at privacy@heartchive.com.

Your Content

You own the content you save in Heartchive. By uploading or entering content, you give Heartchive a limited license to securely store, encrypt, and process that content solely to provide and maintain the Service. You are responsible for ensuring you have the rights to upload the content you add. Do not upload harmful, unlawful, or infringing material.

App Functions & Support

We work to ensure the Service runs smoothly, but availability and features may change over time. We may modify or suspend certain features as we continue to improve Heartchive.

Not Medical or Emergency Advice

Heartchive does not provide diagnosis, treatment, clinical guidance, or crisis support. If you need medical or mental health assistance, or if you are in danger, contact emergency services or a crisis hotline in your region. You acknowledge Heartchive is not a substitute for professional help.

Subscriptions and Purchases

If you choose to purchase a subscription, Apple’s in-app purchase terms apply. Subscriptions automatically renew until canceled in your App Store settings. Pricing changes will be communicated in advance as required by Apple policies.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information. Please review it carefully: www.heartchive.com/privacy

Acceptable Use

You agree that you will not misuse Heartchive. This includes attempting to access others’ accounts or data, introducing malware, scraping data, interfering with security, or using the platform to harass or harm others. We may suspend or disable accounts that violate these rules or put users at risk.

Intellectual Property

Heartchive owns the software, design, and branding that make up the Service. You may not copy, reverse engineer, or modify any part of the platform except as allowed by these Terms.

Termination

You may delete your account at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the safety and integrity of the Service.

Limitation of Liability

To the fullest extent permitted by law, Heartchive is not liable for indirect, incidental, special, or consequential damages, including loss of data or profits. The Service is provided “as is” without warranties of uninterrupted or error-free operation.

Governing Law

These Terms are governed by the laws of the State of California, unless local law requires otherwise. If any part of these Terms is unenforceable, the rest will still apply.

Your Responsibility for Your Use

You are responsible for the content you add to Heartchive and for how you use the Service. If your actions cause legal claims against Heartchive, you agree to work with us to resolve them.

Changes to These Terms

We may update these Terms as Heartchive grows. If changes are material, we will notify you in the app or by email before they take effect. The “Last Updated” date above reflects the most recent version.
